Terms and Conditions

IMPORTANT NOTICE: Please read these Terms and Conditions carefully before using our services. By submitting milk or making a payment, you confirm acceptance of all terms herein. These Terms constitute a legally binding agreement under the laws of the United Arab Emirates.

1. COMPANY DESCRIPTION & LEGAL STATUS

Mom’s Pure Milk R&D FZ LLC (hereinafter “MPM”, “we”, “us”, or “the Company”) is a Research and Development company duly incorporated and registered as a Free Zone Limited Liability Company (FZ-LLC) in the United Arab Emirates, operating under the regulatory authority of Dubai Healthcare City (DHCC). MPM holds a valid R&D operating licence issued under the applicable laws and regulations of the UAE free zone system.

MPM provides a highly controlled, contactless, freeze-drying preservation service for human breast milk, exclusively for mothers submitting their own milk, to be returned solely to them for personal use for their own children.

2. RESEARCH & DEVELOPMENT LICENCE STATUS

MPM operates under an official Research & Development (R&D) licence. All clients must acknowledge and accept the following:

  • MPM’s freeze-drying service is non-medical and is NOT classified as a pharmaceutical, clinical, therapeutic, or medical-grade procedure;
  • Freeze-dried breast milk is NOT intended to diagnose, treat, cure, or prevent any disease, illness, or medical condition;
  • The freeze-drying format for breast milk is subject to ongoing R&D; outcomes may vary based on individual maternal health, diet, milk composition, and storage conditions prior to submission;
  • MPM does not provide medical advice, clinical recommendations, diagnosis, or any form of product guarantee or warranty;
  • All services are rendered within the strict scope and limitations of the Company’s current R&D licence;
  • The R&D licence does not authorise MPM to make clinical or nutritional efficacy claims about the processed product.

3. ACCEPTANCE OF TERMS

By using MPM’s website, submitting breast milk, or making any payment, you (the “Client”) confirm that you:

  • Have read, understood, and agree to be legally bound by these Terms and Conditions in their entirety;
  • Are the biological, adoptive, or surrogate mother of the child for whom the breast milk is intended;
  • Are of legal age (18 years or older) and have the legal capacity to enter into a binding agreement under UAE law;
  • Have sought or will seek appropriate paediatric and/or medical advice regarding the suitability of freeze-dried breast milk for your child;

Acknowledge that these Terms may be updated from time to time and that continued use constitutes acceptance of the latest version.

4. MANDATORY MICROBIAL SAFETY TESTING

4.1  Requirement & Purpose
A mandatory microbial (microbiological) safety screening test is performed on a representative sample drawn from each mother’s milk submission prior to any freeze-drying processing. This testing is a non-negotiable condition of service and cannot be waived, bypassed, or deferred under any circumstances.

The purpose is to ensure that no milk presenting a potential microbiological safety risk is processed and returned to an infant, consistent with the Company’s commitment to infant safety and applicable UAE food and health safety standards.
4.2 Third-Party Laboratory
All microbial testing is conducted exclusively by an independent, accredited third-party laboratory. MPM does not perform in-house microbial testing. The laboratory is selected based on its accreditation credentials, compliance with UAE regulatory standards (including those set by Dubai Municipality, the Ministry of Health and Prevention (MOHAP), and/or other relevant regulatory bodies), and scientific rigour.

All test results, reports, and certifications are issued directly and solely by the external laboratory. MPM does not modify, interpret, alter, or take clinical or scientific responsibility for any laboratory report.

Clients may request the name, location, and accreditation details of the laboratory used for their specific batch by submitting a written request to contact@momspuremilk.com.
4.3  Pass / Fail Parameters
Each sample is assessed against established microbiological safety parameters as defined and applied by the accredited third-party laboratory in accordance with applicable food safety, infant health, and UAE health authority standards.

  • PASS: If the sample meets all required parameters, MPM will proceed with freeze-drying processing. The completed batch will be released and delivered to the mother upon successful quality checks.
  • FAIL: If the sample does not meet one or more required parameters, the batch CANNOT be processed. MPM will notify the Client promptly. The milk will be disposed of in accordance with UAE biohazard disposal regulations. Unprocessed milk cannot and will not be returned to the Client.

4.4  Microbial Testing Fee — AED 300 (NON-REFUNDABLE)
The mandatory microbial testing fee is AED 300 (three hundred UAE Dirhams). This fee compensates the independent third-party laboratory for services rendered and is STRICTLY AND UNCONDITIONALLY NON-REFUNDABLE in ALL of the following circumstances, without exception:

  • The microbial sample passes the required parameters and processing proceeds;
  • The microbial sample fails the required parameters and processing cannot proceed;
  • The milk does not meet MPM’s intake criteria (temperature, packaging, contamination, etc.);
  • The Client cancels the order after the sample has been submitted to the laboratory;
  • The Client requests a refund for any reason after testing has commenced;
  • Any other reason whatsoever, including force majeure events.

The AED 300 fee is payable regardless of outcome. It is non-negotiable.

5. FAILED BATCH — REFUND & CREDIT POLICY

In the event that a microbial test result FAILS and processing cannot proceed, the following policy applies to all processing fees paid by the Client (meaning all amounts paid excluding the non-refundable AED 300 microbial testing fee and any non-refundable nutritional testing fee):

  • OPTION A — MPM Store Credit: The remaining processing fees will be converted to a credit balance on the Client’s Mom’s Pure Milk account. This credit may be applied toward any future order or service with MPM. Store credit is valid for twelve (12) months from the date of issuance, after which it expires with no cash value.
  • OPTION B — Partial Monetary Refund: A refund equal to the total processing fee paid minus the non-refundable AED 300 microbial testing fee (and AED 550 nutritional testing fee if commissioned) will be processed to the Client’s original payment method within fourteen (14) business days of receipt of the Client’s written refund request.

To elect your preferred option, you must notify MPM in writing at contact@momspuremilk.com within fourteen (14) calendar days of receiving notification of the failed test result. If no election is received within this period, Option A (store credit) will be applied automatically.

Refunds are processed in UAE Dirhams (AED). MPM is not liable for any currency conversion losses. MPM reserves the right to verify the Client’s identity and original payment amount before processing any refund.

6. NUTRITIONAL TESTING (OPTIONAL SERVICE)

6.1  Description
In addition to mandatory microbial testing, MPM offers an optional nutritional analysis of the submitted breast milk. This service is conducted by an accredited third-party laboratory and provides a detailed nutritional profile of the milk sample.

6.2  Nutritional Testing Fee — AED 550 (NON-REFUNDABLE)
The nutritional testing fee is AED 550 (four hundred and sixty UAE Dirhams). This fee is STRICTLY AND UNCONDITIONALLY NON-REFUNDABLE under all circumstances, because:

  • The laboratory commences nutritional analysis upon receipt of the sample, irrespective of any microbial test outcome;
  • A nutritional analysis report WILL be issued to the Client regardless of whether the microbial test passes or fails;
  • The report has standalone scientific value as a document of the milk’s nutritional composition, independent of whether processing proceeds.

6.3  Report Issuance & Disclaimer
The nutritional analysis report is issued directly by the accredited third-party laboratory and provided to the Client digitally. MPM does not modify, interpret, or take clinical or nutritional responsibility for the report content. The report is provided for informational purposes only and does not constitute medical or dietary advice.

7. SERVICE FEE SUMMARY

The following table summarises all fees applicable to MPM’s services. All amounts are in UAE Dirhams (AED).

* Processing fees are refundable (as credit or monetary refund) only in the event of a microbial test failure. Non-refundable once processing has commenced. See Section 5.

8. TURNAROUND TIME

The estimated turnaround time for the complete MPM service cycle — including intake verification, mandatory microbial testing, nutritional testing (if commissioned), freeze-drying processing, quality assurance checks, packaging, and preparation for return delivery — is TWO (2) TO THREE (3) WEEKS from the date MPM formally confirms receipt of the Client’s milk submission at our facility.

The following important qualifications apply:

  • The turnaround period is an estimate only and is not a guaranteed deadline. Actual time may vary depending on laboratory schedules, order volume, third-party testing timelines, and circumstances beyond MPM’s control;
  • The turnaround clock commences from the date of confirmed intake at MPM’s facility, NOT from the date of courier dispatch, milk submission, or payment;
  • If a microbial test FAILS, the turnaround process is suspended. The Client will be notified, and processing will not restart unless a new submission is made under a new order;
  • MPM is not liable for delays attributable to third-party laboratory schedules, courier failures, customs delays, or force majeure events as defined in Section 17.

9. QUALITY ASSURANCE & PROCESSING STANDARDS

9.1  Cleanroom Standards
MPM employs stringent quality assurance protocols consistent with ISO 8 cleanroom internal practices. All processing is conducted in a controlled environment designed to minimise contamination risk throughout the freeze-drying cycle.
9.2  Milk Intake Criteria
MPM will only accept and process milk submissions meeting ALL of the following criteria:

  • Arrives frozen solid at or below 0°C (verified upon intake with calibrated equipment);
  • Stored and transported in hygienically sealed, food-grade, approved milk storage bags with clear labelling;
  • Shows no signs of tampering, damage, leakage, tears, or visible foreign contamination;
  • Accompanied by the completed MPM intake form with accurate Client and batch details.

Milk not meeting intake criteria will NOT be processed and will be disposed of per UAE biohazard disposal regulations. Unprocessed milk will not be returned.
9.3  No Additives, Alterations, or Mixing
The milk you submit is the milk we return. MPM strictly does NOT:

  • Add preservatives, thickeners, nutritional additives, or any other substance;
  • Dilute, reconstitute, or chemically alter the milk in any way;
  • Mix, blend, or co-process milk from more than one mother or submission.

9.4  Unique Batch Tracking & Packaging
Every milk submission is assigned a unique batch number from intake through final packaging. Final processed products are sealed in tamper-evident, food-grade packaging labelled with: mother’s full name, unique batch ID, freeze-dry processing date, and shelf-life expiry date.

Once the product is delivered, MPM bears no liability for improper handling, storage, or reconstitution by the Client.
9.5  Shelf Life & Storage
When stored in original sealed packaging in a cool, dry environment away from direct sunlight, freeze-dried milk is shelf-stable for up to three (3) years from the date of processing. Once opened, contents must be consumed within one (1) month, with packaging properly resealed after each use. MPM is not responsible for product safety or nutritional integrity where storage instructions have not been followed.

10. CANCELLATION POLICY

All cancellation requests must be submitted in writing to contact@momspuremilk.com. Oral cancellations will not be accepted. The following cancellation terms apply:

  • Stage 1 — Before Milk Submitted to MPM: Full refund of all fees paid, less any non-refundable administrative or dispatch fees incurred. No testing fees are charged as no sample has been submitted.
  • Stage 2 — After Milk Received by MPM, Before Submission to Laboratory: Full refund of processing fees. Microbial testing fee (AED 300) and nutritional testing fee (AED 550, if commissioned) are non-refundable if the sample has already been committed to the laboratory.
  • Stage 3 — After Sample Submitted to Laboratory (Awaiting Results): Microbial testing fee (AED 300) and nutritional testing fee (AED 550, if commissioned) are non-refundable. Remaining processing fees are refundable subject to Section 5.
  • Stage 4 — After Processing Has Commenced: No refund is available for any processing fees once freeze-drying has begun. All testing fees remain non-refundable.

11. SHARIA COMPLIANCE

MPM is fully committed to operating in compliance with Islamic jurisprudence (Sharia) principles, particularly those relating to milk siblinghood (Rada’a / الرضاعة) as recognised under UAE law and the UAE Personal Status Law. In full alignment with these principles:

  • We do not store, donate, resell, or redistribute any client’s milk to any third party under any circumstance;
  • All milk is processed and returned solely to the same mother who submitted it;
  • MPM does not accept milk from or through any third party, intermediary, or agent;
  • No milk from any Client is mixed, blended, or co-processed with milk from any other Client, eliminating all risk of unknown milk kinship (Rada’a);
  • Each batch is uniquely identified and processed in isolated units to ensure complete separation at all times.

12. PERSONAL USE ONLY

MPM’s service is strictly and exclusively available to individual mothers for personal use of their own breast milk for their own children. Clients expressly agree they will NOT:

  • Sell, donate, gift, transfer, or share the processed freeze-dried milk with any person other than their own child;
  • Submit any other person’s milk for processing under their own name or account;
  • Use the service for any commercial processing, resale, distribution, or institutional supply purpose;
  • Store, distribute, or offer reconstituted breast milk through any online, offline, or third-party channel.

Violation of this clause constitutes a material breach of these Terms and entitles MPM to immediately terminate the Client’s service, forfeit all fees paid, and pursue all remedies available under UAE law.

13. PURCHASES, PAYMENT & BILLING

All purchases must be accompanied by valid, accurate, and complete billing and shipping information. By submitting payment, the Client affirms they are the authorised holder or user of the payment method used. MPM reserves the right to cancel or decline any order where there is a reasonable suspicion of fraud, misrepresentation, or violation of these Terms.

All prices are quoted in UAE Dirhams (AED). MPM is not responsible for any currency conversion fees, bank charges, or foreign exchange losses incurred by the Client in connection with payments made to MPM.

14. PRIVACY POLICY & DATA PROTECTION

MPM is committed to protecting Client personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) and all other applicable UAE data protection laws and regulations.

By using our services, you consent to the collection, storage, and use of the following personal data for service delivery, communications, and legal compliance: full name, contact details (email, phone, address), payment and billing information, health and milk-related data submitted for service purposes, and laboratory results and batch processing records.

MPM will not sell, rent, or share your personal data with third parties except: (a) the accredited testing laboratory for testing purposes; (b) logistics/courier partners for delivery; (c) as required by law, court order, or UAE regulatory authority.

Clients have the right to access, correct, or request deletion of their personal data by contacting contact@momspuremilk.com. MPM will respond to all data requests within thirty (30) days in accordance with UAE PDPL requirements.

15. COMMUNICATIONS & MARKETING

By providing your contact details to MPM, you consent to receiving service-related communications, order updates, and (where separately opted into) promotional or marketing communications. You may withdraw consent to marketing communications at any time by emailing contact@momspuremilk.com or using the unsubscribe link in any marketing email. Service-critical communications (batch status, test results, delivery notifications) cannot be opted out of while an active order is in progress.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable UAE law, the Client accepts all risks associated with the shipment, intake, testing, processing, packaging, and post-delivery use of freeze-dried breast milk. MPM’s total aggregate liability to any Client shall not exceed the total amount paid by that Client for the specific order giving rise to the claim. MPM is not liable for any indirect, consequential, special, punitive, or incidental damages of any kind.

MPM is specifically not liable for:

  • Compromised milk quality or safety before the milk reaches MPM’s facility;
  • Any health outcomes, adverse reactions, or illnesses resulting from use, consumption, or improper handling of the processed product;
  • Allergic reactions or sensitivities to any components naturally present in human breast milk;
  • Delays in processing or return delivery due to third-party laboratory schedules, courier failures, or force majeure events;
  • Inadvertent contamination originating from conditions prior to arrival of the milk at MPM’s premises;
  • Errors, omissions, or delays in third-party laboratory results or reports;
  • Loss or damage caused by inaccurate Client information, including incorrect delivery address or contact details.

17. MEDICAL DISCLAIMER

MPM strongly recommends that all Clients consult with their registered paediatrician, healthcare provider, or lactation specialist before using freeze-dried breast milk for their child. This is particularly important for: premature or low-birth-weight infants; immune-compromised or medically vulnerable infants; infants with known allergies, sensitivities, or special dietary requirements; and any infant under the care of a medical specialist.

MPM does not provide medical advice, dietary recommendations, clinical guidance, treatment plans, or product guarantees of any nature. Nothing in these Terms or in any MPM communication constitutes medical advice.

18. FORCE MAJEURE

MPM shall not be held liable for any delay or failure to perform where such delay or failure results directly or indirectly from events beyond MPM’s reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, government orders, regulations or restrictions, power failures, refrigeration failures during transit, equipment breakdowns, IT system failures, shipping or logistics disruptions, and laboratory closures or testing disruptions.

In the event of a force majeure situation, MPM will notify the Client as soon as reasonably practicable and will use reasonable endeavours to resume normal service as soon as the force majeure event has passed.

19. INTELLECTUAL PROPERTY

All intellectual property rights in and to MPM’s name, logo, trademarks, service marks, trade secrets, processing methodologies, digital content, website design, documentation, and packaging designs are and shall remain the exclusive property of Mom’s Pure Milk R&D FZ LLC. These rights are protected under UAE Federal Law No. 37 of 1992 on Trademarks (as amended) and Federal Law No. 38 of 2021 on Copyrights and Neighbouring Rights.

Clients and third parties may not reproduce, copy, reverse-engineer, distribute, modify, or use any MPM intellectual property without prior explicit written consent. Unauthorised use may result in civil and criminal liability under UAE law.

20. INDEMNIFICATION

The Client agrees to indemnify, defend, and hold harmless MPM, its directors, officers, employees, agents, and service providers from and against any and all claims, liabilities, damages, judgments, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: the Client’s violation of any provision of these Terms; the Client’s use of MPM’s services in violation of applicable law; any inaccurate or false information provided by the Client to MPM; or any claim by a third party arising out of the Client’s actions in relation to the processed milk.

21. MODIFICATIONS TO SERVICES & TERMS

MPM reserves the right at any time to change, pause, suspend, or permanently discontinue any or all of its services; revise, amend, or update these Terms and Conditions; or change its pricing. Any updates will be posted on MPM’s website with the effective date clearly indicated. Continued use of MPM’s services after an update constitutes acceptance of the revised Terms. It is the Client’s responsibility to review these Terms regularly.

22. GOVERNING LAW & DISPUTE RESOLUTION

These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United Arab Emirates, including applicable federal laws and the laws and regulations of Dubai Healthcare City Authority (DHCA).

In the event of any dispute, the parties agree to first attempt to resolve it amicably through good faith negotiations within thirty (30) days of written notice of the dispute. If the dispute cannot be resolved amicably within that period, it shall be referred to and finally resolved by the competent courts of the Emirate of Dubai, UAE.

In the event of any conflict between the English and Arabic versions of these Terms, the English version shall prevail for legal interpretation purposes, unless otherwise required by applicable UAE law.

23. SURVIVABILITY & SEVERABILITY

Any provision which by its nature is intended to survive expiry, cancellation, or termination — including limitation of liability, intellectual property, indemnification, governing law, and data protection provisions — shall continue in full force and effect after termination.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed, and the validity, legality, and enforceability of the remaining provisions shall not be affected.

24. WAIVER

No failure or delay by MPM in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.

25. ENTIRE AGREEMENT

These Terms and Conditions, together with MPM’s Privacy Policy and any separate written service agreement or order confirmation issued by MPM, constitute the entire agreement between the Client and MPM and supersede all prior or contemporaneous understandings, representations, warranties, and agreements, whether written or oral.

26. CLIENT ACKNOWLEDGEMENT & DECLARATION

By submitting milk to MPM for processing or making any payment, the Client irrevocably acknowledges, confirms, and declares the following:

  • I have read and fully understood these Terms and Conditions in their entirety, including all fee structures, non-refundable charges, turnaround times, and limitations of liability;
  • I agree that the mandatory microbial testing fee of AED 300 is non-refundable under all circumstances, including where the test fails;
  • I understand that the optional nutritional testing fee of AED 550 is non-refundable and that a nutritional report will be issued regardless of microbial test outcome;
  • I understand that the estimated turnaround time is 2 to 4 weeks and that this is not a guaranteed deadline;
  • I acknowledge MPM’s R&D FZ-LLC status and the non-medical, non-clinical nature of all services;
  • I confirm that I am the legal mother or authorised guardian of the child for whom the milk is intended and that I will use the processed product solely for that child’s personal use;
  • I confirm that all information provided to MPM is accurate, truthful, and complete;
  • I have sought or will seek appropriate medical advice from a qualified healthcare professional before using the freeze-dried product for my child.

27. SERVICE PACKAGE PRICING

The following package pricing applies to MPM services:


• MPM Discovery Package (500ml + Nutritional Testing Included): AED 850
• 2L Package: AED 1,250
• 4L Package: AED 2,400
• 6L Package: AED 3,600
• 8L Package: AED 4,200
• 10L Package: AED 5,400
• 12L Package: AED 6,400
• Nutritional Testing Add-On (2L+ Packages Only): AED 550

All pricing is inclusive of mandatory microbial testing unless otherwise stated. MPM reserves the right to update pricing at any time in accordance with Section 21 of these Terms and Conditions.

28. PAYMENT METHODS, INSTALLMENTS & CHARGEBACKS

MPM may offer payment through third-party installment or deferred payment providers including but not limited to Tabby and Tamara. By selecting such payment methods, the Client acknowledges and agrees that:
1. Any refund, dispute, reversal, installment cancellation, or chargeback request initiated through Tabby, Tamara, or any third-party payment provider shall be governed by the terms and policies of that provider.
2. MPM is not liable for delays, penalties, rejected refunds, frozen installments, administrative fees, or financing disputes arising from third-party payment providers.
3. Once testing or processing has commenced, all non-refundable fees remain non-refundable regardless of any dispute or chargeback request raised through the payment provider.
4. In the event of fraudulent chargebacks, payment reversals, or disputes inconsistent with these Terms and Conditions, MPM reserves the right to pursue all legal remedies available under UAE law, including debt recovery and legal claims.
5. For direct payments made to MPM through bank transfer, payment link, POS, or direct card payment, refunds shall only be processed in accordance with MPM’s official refund policy stated herein.

Additional Turnaround Conditions:

1. MPM operates on a strict first-in, first-out processing model.
2. Only one mother’s milk batch is processed at a time to ensure complete batch integrity, isolation, and contamination control.
3. Due to demand fluctuations, laboratory capacity, quality assurance procedures, and the Company’s one-batch-at-a-time operational model, turnaround timelines may extend beyond the estimated timeframe.
4. MPM shall not be liable for any delays arising from high order volumes, operational prioritisation requirements, laboratory timelines, or quality assurance holds necessary to maintain safety and processing standards.
